This topic addresses how you are allowed to use the assets that we provide. The question of license models for content in Train Simulator NEXT is a different one and will is handled in a different article.
When creating content, we use content from other companies that make their content available to us via a database and standardized licenses. We sometimes use third-party content such as materials, texture resources, audio resources, but also 3D models in a few cases. We use resources from the following platforms:
- → Adobe Substance 3D Assets
- → Adobe Substance 3D Community Assets
- → Audiojungle.com
- → Textures.com
Since we do not want to carry out individual license considerations for each model, we have made sure that the following rules apply to all our derived assets (hereinafter simply assets). All these rights and restrictions can be found in the end-user license agreement (EULA). If conditions in the EULA are from a newer date, they apply.
The following rights apply:
- You may use the assets in your “modified works” or “larger works” if they are used directly with Train Simulator NEXT and do not violate any restrictions.
- You may derive your own “modified works” or “larger works” from the asset data such as 3D models and textures free of charge if these are used directly with Train Simulator NEXT and do not violate any restrictions.
The following restrictions apply:
- You may not copy, publicly display, publicly perform, distribute or sublicense any asset resource (3D models, but especially textures) unless it has been modified into a “modified work” or incorporated into a “larger work”.
- You may not use any asset resource in a pornographic, defamatory, or otherwise unlawful manner.
- You may not use an asset resource to create a copyrighted work that sublicenses and/or inherits these assets to alter, restrict, or infringe the rights of any source, user, or subsequent user, or facilitate commercial acquisition by any third party. This expressly excludes the use of copyleft licenses, such as GPL licenses, as well as use in the sense of performing rights organizations or similar forms of exploitation.
- You may not engage in any activity that disrupts or disrupts Train Simulator NEXT or any other party involved, including its servers and associated networks.
The term “larger work” means a new copyrighted work containing an unmodified Train Simulator NEXT asset. The term “modified work” means a new copyrighted work created, at least in part, by modification of one or more Train Simulator NEXT assets.
The term “asset” means resources like shapes and maps in the application directory in the Content/Assets/Train Simulator NEXT/ and Content/Trains/Train Simulator NEXT/ directories. It does not apply to other content or to built greater work in Train Simulator NEXT, like routes; If given, rights and restrictions may differ from case to case for this kind of content.
